Terms of Service
These Terms of Service set out the conditions for using the rental car services provided by Ishigaki Mirais Rent-a-Car (the “Company”). Please read them carefully before making a reservation or using the services. For business-operator information and sales conditions, please also review the Notation based on the Act on Specified Commercial Transactions, and for the handling of personal information, please review the Privacy Policy. The official Rental Car Lending Terms that govern the lending conditions are posted at the bottom of this page.
Article 1 (Scope of Application)
These Terms apply in all cases where a customer (the “Renter”) reserves or uses the Company’s rental car services. In addition to these Terms, the Lending Terms posted at the bottom of this page and other conditions separately established by the Company shall apply to the actual lending. If there is any discrepancy between these Terms and the Lending Terms, the Lending Terms shall prevail.
Article 2 (Formation of a Reservation)
- (1) A reservation is formed at the point when the Company accepts the reservation by its prescribed method and sends a reservation confirmation to the customer.
- (2) Depending on vehicle availability and other factors, the Company may be unable to accept a reservation.
- (3) Changes to reservation details (schedule, vehicle class, options, etc.) will be accepted within the scope set out in Article 5.
Article 3 (Lending Conditions and Driving Eligibility)
Anyone who will drive the vehicle must satisfy all of the following conditions at the time of lending.
- (1) Be 21 years of age or older.
- (2) Hold a valid ordinary driver’s license. Customers holding a license issued overseas (an International Driving Permit under the Geneva Convention, or a foreign license permitted for driving in Japan together with a prescribed translation, etc.) may also use the service.
- (3) Not be under suspension or revocation of a driver’s license, and not be driving without a license.
All drivers must present their driver’s licenses at the time of lending. Persons other than the driver(s) registered at the time of reservation may not drive the vehicle.
Article 4 (Fees and Payment)
- (1) Rental fees are based on the fee structure (basic fee, various options, coverage, etc.) presented at the time of reservation.
- (2) Payment shall be made by the method designated by the Company (advance payment by credit card, payment on site, etc.).
- (3) For reservations made via an OTA (travel-booking site, etc.), fees and payment methods are subject to the rules of each booking site.
Article 5 (Cancellation and Changes to a Reservation)
For cancellation of a reservation, a cancellation fee will be charged according to the number of days remaining until the pick-up date (lending start date), as shown in the table below.

- (1) Changes to reservation details (schedule, vehicle class, etc.) are accepted with no change fee. However, the fee may vary depending on the conditions after the change.
- (2) In special circumstances such as bad weather or flight cancellations, we will consult with you regarding the cancellation fee, so please contact us as early as possible.
- (3) For reservations made via an OTA, the cancellation rules may be subject to the rules of each booking site.
Article 6 (Prohibited Acts)
The Renter must not engage in any of the following acts. In the event of a violation, the Company may terminate the lending contract and claim compensation for any damages incurred.
- (1) Allowing anyone other than the driver(s) registered at the time of reservation to drive (including subletting or re-lending).
- (2) Driving without a license, driving under the influence of alcohol, or driving under the influence of narcotics, drugs, etc.
- (3) Using the vehicle for any purpose other than that of the lending (business, competition, towing, uses contrary to the Road Transportation Act, etc.).
- (4) Taking the vehicle outside Japan, or reselling, providing it as collateral, etc. without the Company’s approval.
- (5) Smoking inside the vehicle (including e-cigarettes). In the event of a violation, a separate cleaning fee may be charged.
- (6) Bringing pets on board without the Company’s consent; or, even where consent has been given, letting a pet out of its cage inside the vehicle.
- (7) Any other act contrary to laws, regulations, or public order and morals.
Article 7 (Accidents, Breakdowns, and Theft)
- (1) In the event of an accident, breakdown, theft, etc., please contact the police and the Company immediately. If you fail to contact the Company, you may not be eligible for compensation.
- (2) The Company maintains the prescribed automobile insurance (bodily-injury liability, property-damage liability, vehicle, and personal-injury) on the lent vehicle. The scope of coverage, the deductible (excess), and the applicable conditions are as set out in the Lending Terms.
- (3) The deductible (the customer’s self-pay amount), and the Non-Operation Charge (NOC) as compensation for the period during which the vehicle cannot be used for business due to an accident, breakdown, soiling, etc., are as set out in the Lending Terms.
- (4) For damages arising from the Renter’s intentional act or gross negligence, or from use contrary to these Terms or the Lending Terms, insurance and coverage may not apply, and the Renter may be required to bear the full amount.
Article 8 (Refueling and Return)
- (1) In principle, please return the vehicle with a full tank (the same fuel level as at the time of lending) — a “full-tank return.” If the tank is not full, the Company’s prescribed refueling charge will be applied.
- (2) Please return the vehicle at the reserved return date/time and return location. If you must extend, be sure to contact the Company before the scheduled return time.
- (3) In the event of an unauthorized late return or extension, you may be required to bear the extension charge and any damages incurred by the Company. Extension charges are as prescribed by the Company.
Article 9 (Handling of Personal Information)
The Company will appropriately handle the personal information of customers obtained in connection with reservations and lending, in accordance with the Privacy Policy.
Article 10 (Exclusion of Anti-Social Forces)
The Renter represents and warrants that it is not an organized crime group, a member of such a group, an affiliated company thereof, a corporate racketeer, or any other anti-social force (collectively, “Anti-Social Forces”), and that it has no relationship with Anti-Social Forces.
If it becomes clear that the Renter is an Anti-Social Force, or if the Renter engages in violent or threatening conduct or other improper demands, the Company may terminate the lending contract without any prior notice.
Article 11 (Disclaimers and Limitation of Liability)
- (1) Except in cases due to causes attributable to the Company, the Company shall not be liable for any damage incurred by a customer or a third party in connection with the lending of a vehicle.
- (2) The Company shall not be liable for any damage where the provision of services is delayed or suspended due to natural disasters, traffic conditions, road conditions, circumstances peculiar to remote islands (suspension of ferry or flight services, etc.), or other causes not attributable to the Company.
Article 12 (Governing Law and Jurisdiction)
These Terms and the contract between the Company and the customer shall be governed by the laws of Japan. Any dispute arising between the Company and the customer in connection with this service shall be subject to the exclusive agreed jurisdiction of the court having jurisdiction over the Company’s location as the court of first instance.
Article 13 (Severability)
Even if any provision of these Terms, or any part thereof, is held to be invalid or unenforceable, the remaining provisions of these Terms and the remaining part of such provision shall continue in full force and effect.
Article 14 (Changes to These Terms)
The Company may change these Terms as necessary. The revised Terms shall take effect from the time they are posted on the Company’s website.
